1. Acceptance of Terms

By downloading, installing, or using the GoodWatch mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.

2. Description of Service

GoodWatch is a movie recommendation service that provides personalized movie suggestions based on your mood, available time, and streaming platform preferences. The Service helps users discover content available on various streaming platforms.

GoodWatch does not provide streaming content itself. We recommend content that is available on third-party streaming platforms. You must have valid subscriptions to those platforms to watch the recommended content.

3. User Eligibility

You must be at least 18 years of age to use the Service. If you are under 18, you may only use the Service with verifiable parental or guardian consent, in accordance with the Digital Personal Data Protection Act, 2023 (India). By using the Service, you represent and warrant that you meet this age requirement.

4. User Accounts

GoodWatch offers account creation via Google Sign-In, Apple Sign-In, or email. Creating an account allows you to sync preferences across devices, manage your watchlist, and access premium features.

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account. You may request deletion of your account and all associated data at any time (see Section 16).

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to it
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use automated means (bots, scrapers, etc.) to access the Service
  • Transmit any viruses, malware, or harmful code
  • Impersonate any person or entity
  • Use the Service to send spam or unsolicited communications

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by GoodWatch and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Movie titles, posters, descriptions, and other content displayed in the Service are the property of their respective owners. GoodWatch displays this information for recommendation purposes only and does not claim ownership of third-party content.

7. Third-Party Services and Data Processing

The Service integrates with third-party services for authentication, analytics, push notifications, subscription management, and email delivery. These include Firebase (Google), Supabase, RevenueCat, PostHog, OneSignal, ZeptoMail (Zoho), Google Analytics 4, and TMDB. Each service processes data solely for the purposes described in our Privacy Policy.

The Service may also contain links to third-party streaming platforms. These platforms are governed by their own terms and privacy policies. GoodWatch is not responsible for the content, policies, or practices of any third-party services. Your use of streaming platforms to watch recommended content is subject to your agreements with those platforms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee that recommendations will match your preferences or that content will be available on all platforms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOODWATCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us for the Service, if any, in the past twelve months.

10. Indemnification

You agree to indemnify and hold harmless GoodWatch and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may stop using the Service at any time by uninstalling the app and discontinuing use of the website. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of India.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Subscriptions and Payments

GoodWatch offers a free tier with limited daily recommendations and a paid subscription (GoodWatch Pro) with unlimited access. Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.

Payment processing is handled entirely by Apple. GoodWatch does not collect, store, or process any payment card details. You may cancel your subscription at any time through your App Store settings.

15. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023 (India).

As a Data Principal under the DPDP Act, you have rights including access to your data, correction of inaccurate data, erasure of your data, and grievance redressal. To exercise these rights, contact us at hello@goodwatch.movie.

16. Account Deletion

You may request deletion of your account and all associated personal data at any time through the app (Profile > Delete Account) or by emailing hello@goodwatch.movie. Deletion requests are processed within 30 days.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoodWatch regarding the Service and supersede all prior agreements and understandings.
